The Fishidy "Braggin' Board" Contest and Sweepstakes

NO PURCHASE NECESSARY. THIS CONTEST AND SWEEPSTAKES ARE VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. ELIGIBILITY: To enter contestants must be 18 years or older at the time of entry and living in the USA. This contest is void where it is prohibited or restricted by laws in that state. Employees (and their immediate family members or those living in the same household) of Fishidy and its affiliated companies, subsidiaries, divisions, parents and related companies, promotion agencies, and any and all other companies associated with the Contest are not eligible to participate. The term "immediate family member" includes spouses, grandparents, parents, siblings, children, nieces, nephews and grandchildren.
2. HOW TO ENTER THE CONTEST: To enter the Contest, go to www.fishidy.com or go to the Fishidy app on your smart phone, and click on the Enter Contest icon and follow the directions to complete the entry form a nd post your catch to the Braggin' Board Contest Page. Entries must be in one of these formats: JPEG/ JPG, PNG, or GIF (animated or non-animated). All required fields on the entry form must be completed for the entry to be valid. By posting to the Braggin' Board, the photo, user's first name, date, species caught, waterway name, and lure will be displayed on the publically available Braggin' Board web site. All entries become the property of Fishidy.
3. HOW WINNERS ARE SELECTED: Each week, a new contest begins Monday morning at 12:01 am CST, and ends Sunday at 11:59 pm CST. During that week consumers will be allowed to "vote" on their favorite entry. On each Monday, after reviewing all entries from the previous week posted on the Braggin' Board, an independent judge will select the winner from among valid entries. The winner each week will be judged based on the following criteria: votes by consumers - 50%, and size of fish and quality of picture - 50%. The decisions of Fishidy are final and binding on all matters relating to this Contest.
4. SUBMISSION OF PICTURES: All images must be your original creation and you must own all rights, title and interest in all aspects of the picture. By submitting an image, you represent and warrant that the image is: (a) your original creation in accordance with these Rules, (b) has not been copied in whole or in part from any other work; and (c) does not violate or infringe any copyright, trademark, privacy, publicity or other proprietary right of any person or entity. By submitting an image, you further represent and warrant that you have all necessary rights to grant Fishidy all publication and use rights. If you submit an image which includes another person or persons, you acknowledge and confirm you have their permission and consent. Contestant accepts responsibility to hide all corporate logos, (i.e., on clothing, etc.), obscenities and/or other graphics which may be deemed offensive. By submitting an image, you grant Fishidy permission to post on the Internet for public viewing and for possible use in promotional materials including print, online, social media, Facebook, e-newsletters, videos and/or in-store without further compensation or notice to you; to modify, edit, adapt, and electronically alter the video without further compensation or notice to you; and if your image is selected as a winner to post your name (first only) along with your picture on the winners' list.
5. CONTEST PRIZES: Each week the winner will receive the following: a complimentary 1-year Fishidy premium subscription. Approximate Retail Value (ARV) of weekly prizes is: $49.99.
6. HOW TO ENTER THE SWEEPSTAKES: No purchase necessary. There are two ways to enter the sweepstakes: 1) post a picture of your catch to the "Braggin' Board" as outlined in the How To Enter The Contest Section, or 2) go to www.fishidy.com, register as a member if you are not already a member, click on the "Enter Sweepstakes" icon and follow the instructions to complete and submit the entry form. All entries into the weekly Fishidy Braggin' Rights Contest are automatically entered into the sweepstakes. Contestants do not need to do anything additional. Entries property of Sponsor and will not be acknowledged or returned, and no correspondence will be entered into by Sponsor to entrant. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute arises regarding the identity of the entrant, the authorized subscriber of the e-mail account, at the time of entry, will be considered the entrant. The definition of an account subscriber is the natural person who is assigned an e-mail address by an internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any use of robotic, automatic, mechanical, programmed or like means to enter the Sweepstakes online will void all such online entries affected by such methods. Sponsor reserves the right to disqualify any individual using such a method. Sponsor and its agencies are not responsible for unauthorized human intervention, phone, technical, network, electronic, computer, hardware or software failures, malfunctions or disconnects of any kind, interrupted or unavailable network, server or other connections, or misdirected, illegible, incomplete, stolen, garbled, fragmented or delayed internet/e-mail computer transmissions or network/ISP/website internet accessibility/availability; or for incorrect or incomplete capture of any information.
7. GENERAL CONDITIONS: Fishidy reserves the right to amend the Official Rules at any time at its sole discretion. Please check the Official Rules posted on The Fishidy's website for any changes/modifications. Fishidy and its respective employees, agents and representatives are not responsible for incorrect or inaccurate transcription or loss or delay of entry or prize reply information, or for any technical or human errors associated with the Contest. By entering and participating in the Contest, you agree: (i) to abide by and be bound to the Official Rules and decisions of Fishidy. Fishidy reserves the right, in its sole discretion, to disqualify and/or deem ineligible any individual it suspects to be in violation of, or has failed to agree to these Official Rules, or to be acting in a disruptive or dishonest manner; and (ii) Fishidy reserves the right to cancel or modify the Contest or Sweepstakes if fraud or any other factor impairs the integrity of the Contest as determined by Fishidy, in its sole discretion. lf, in Fishidy's opinion, there is any suspected or actual evidence of tampering with any portion of the Contest or Sweepstakes, or if the integrity of the Contest or Sweepstakes is otherwise compromised, Fishidy reserves the right, in its sole discretion, to void any submissions at issue (including disqualifying any individual who tampers with the submission process), and to cancel, terminate, modify or suspend the Contest or Sweepstakes, in whole or in part, at any time without notice.
8. DISCLAIMER: Fishidy, or any of their agents or contractors are not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive entry information on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, or the incorrect or inaccurate capture of entry information or the failure to capture any such information. Fishidy is also not responsible for any injury or damage to contestants' or any other persons' computers related to or resulting from participating or downloading any materials in the Contest or for any electronic mail that is late, lost, misdirected, damaged, incomplete, or illegible. If the Contest becomes technically corrupted or compromised due to any of the foregoing factors or non-authorized human intervention, Fishidy reserves the right, in its sole discretion, to terminate the Contest in its entirety or to select potential winners from all eligible submissions received prior to termination. Notwithstanding anything to the contrary contained herein, Fishidy reserves the right to cancel, terminate or modify any promotion not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. Apple, Inc. is not a sponsor of the Braggin' Board.
9. LIMITATION OF LIABILITY: In no event will the Fishidy, , or Facebook or their parents, affiliates, subsidiaries, and related companies, or its respective officers, directors, employees, representatives, agents, contractors, successors and assigns (collectively, the "releasees") be responsible for any claims, actions, demands, losses, liabilities, damages, costs and expenses (including, attorneys' fees) of any kind, including without limitation, direct, indirect, incidental, consequential or punitive damages, whether foreseeable or not and whether based on negligence or otherwise, arising out of your participation in the contest, (including but not limited to actions taken by contestant and/ or any other person(s) to generate the video(s) submitted in this contest), the acceptance, possession, use, misuse, loss or misdirection of any prize, participation in any contest related activities or access to and use of any internet site, and you agree to release, defend, indemnify, discharge and hold harmless the releases from any such claims, actions, demands, losses, liabilities, damages, costs and expenses, including, without limitation from any damage, injury, death, loss or other liability either at law or equity whether known or unknown, asserted or not asserted that may arise from or in any way relate to your participation in the contest (including but not limited to actions taken by contestant and/or any other person(s) to generate the video(s) submitted in this contest), or the awarding, acceptance, use or misuse of any prize. Without limiting the foregoing, the contest, the prize and materials are provided "as-is" without any warranty (except for manufacturers' warranties, if any) or representation of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose and non- infringement.
10. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules or the Affidavit will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Fishidy's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as "may" are used in these Official Rules, Sponsor has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest-related materials, privacy policy or terms of use on the Website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved at Fishidy's sole and absolute discretion. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Participant is providing information to Fishidy and not to Facebook.
11. GOVERNING LAW: This Contest will be governed by and construed in accordance with the laws of the state of Wisconsin without giving effect to any choice of law or conflict of laws rules or provisions.
